Simon Cowell could be forced to testify against Cheryl Cole if she appears in court to sue producers of the X Factor USA.
The 53-year-old music mogul is apparently top of the witness list for the production company Blue Orbit, should the case make it in front of a jury.
Cole announced that she would be seeking £1.4million unpaid fees following her sacking in 2011.
They include £62,000 each year for clothes and £16,000 for hair and make-up.
She also wants £9,400-a-month for rent she claims was promised by the company, and £1,600-a-month for living expenses.
An insider revealed: "Everyone is surprised by the lawsuit. No judge would be paid for a season they didn't appear on."
According to the court papers, the company agreed to pay her on a 'pay or play' basis, and claims that she was guaranteed to receive the money even if she didn't appear on the second series.
Cole claims that she was promised £1.1million for Season One and £1.2million for Season Two. She says that expenses weren't paid for either series.
